Terms of Service

Effective August 4, 2026

These Terms of Service govern purchases and use of RecoverNode assessments, deployment services, downloadable materials, monitoring and recovery software, and Managed Resilience Support.

Services and scope

RecoverNode provides infrastructure assessment, configuration guidance, monitoring and recovery software, installation services, and related technical support. The specific scope, supported systems, deliverables, and any installation work are determined by the product purchased and any written agreement or approved project scope.

Purchase of a package does not guarantee that every server, operating system, network design, hosting provider, or application can be supported. RecoverNode may recommend changes, decline an unsafe configuration, or propose a different scope after reviewing the environment.

Customer authorization and responsibilities

You represent that you own or are authorized to administer every system submitted for assessment, installation, monitoring, or support. You are responsible for maintaining current backups, confirming restoration procedures, providing accurate environment information, approving maintenance windows, and controlling credentials and administrative access.

Do not submit passwords, private keys, access tokens, or other credentials through public website forms. Credentials required for authorized work must be exchanged through a separately agreed secure process.

Operational limitations

RecoverNode is not a substitute for backups, redundant infrastructure, disaster recovery planning, clustering, security monitoring, or a qualified system administrator. It does not guarantee uninterrupted availability, prevention of data loss, or recovery from every hardware, software, network, power, configuration, security, or third-party failure.

Automated recovery can restart services or reboot protected hosts when enabled and when configured safeguards permit the action. Test mode, health checks, retry thresholds, recovery budgets, cooldown periods, hardware watchdog behavior, and lockout conditions must be reviewed and tested before production use.

One-time purchases

Detailed Technical Assessment and Complete Two-Node Deployment are one-time purchases unless a separate written agreement states otherwise. Prices and included deliverables are shown before Checkout.

Secure download links normally expire after 30 days. You are responsible for downloading and securely retaining purchased materials during that period.

Managed Resilience Support subscription

Managed Resilience Support is a recurring monthly subscription. The subscription renews automatically at the price shown during Checkout until canceled.

By subscribing, you authorize the payment provider to charge the selected payment method for each recurring billing period, including applicable taxes where required.

Subscription billing information, invoices, payment methods, and cancellation options are available through the customer billing portal.

Cancellation

You may schedule cancellation through the customer billing portal. Unless otherwise stated during cancellation, a subscription scheduled to cancel at the end of the current billing period remains active through the paid-through date and will not renew afterward.

An immediately canceled, unpaid, paused, incomplete, or expired subscription may lose access to subscription-only downloads and support. A subscription marked past due may receive a temporary grace period while payment recovery is attempted.

Canceling a subscription does not reverse charges already incurred for a completed billing period.

Support scope

Managed Resilience Support covers reasonable assistance related to the supported RecoverNode deployment and the environment documented for that subscription. It does not include unlimited systems administration, emergency incident response, unrelated application development, security remediation, data recovery, hardware replacement, or work outside the agreed environment unless separately approved.

Support is provided on a commercially reasonable basis. Response and resolution times are not guaranteed unless a separate written service-level agreement expressly provides otherwise.

Refunds

Refund requests are reviewed based on the product purchased, work already performed, materials delivered, and the circumstances of the request. Completed assessments, completed installation work, consumed support time, and downloaded digital materials may be non-refundable to the extent permitted by law.

Approved refunds are returned through the original payment method. Payment-provider processing times may affect when the refunded amount appears.

Payment failures

Failed or overdue subscription payments may result in payment retries, past-due status, suspension of subscription benefits, or cancellation. You are responsible for keeping billing and payment information current through the customer billing portal.

Third-party services

RecoverNode may depend on operating systems, hosting providers, email services, payment processors, certificate authorities, domain providers, internet providers, and other third-party systems. RecoverNode is not responsible for outages, policy changes, service limitations, or failures caused by those third parties.

Acceptable use

You may not use RecoverNode materials or services to access, monitor, alter, disrupt, or control systems without proper authorization. You may not resell, publish, redistribute, reverse engineer, or remove ownership notices from purchased materials or software except where expressly permitted in writing or required by applicable law.

Limitation of liability

To the fullest extent permitted by law, RecoverNode will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, lost data, business interruption, or loss of goodwill arising from use of or inability to use the services.

To the fullest extent permitted by law, RecoverNode's total liability arising from a product or service will not exceed the amount paid to RecoverNode for that product or service during the six months preceding the event giving rise to the claim.

Changes to these terms

RecoverNode may update these terms as products, billing practices, or legal requirements change. Updated terms will be posted on this page with a revised effective date. Changes do not retroactively alter completed one-time purchases unless required by law.
